3/10/2010 - Zoning By-law Amendment

THE CORPORATION OF THE

MUNICIPALITY OF CALVIN

Notice of the Passing of an Amendment to the Zoning By-Law of

the Corporation of the Municipality of Calvin

TAKE NOTICE that the Council of the Corporation of the Municipality of Calvin passed By-law No.

2010-008 on March 9, 2010, under Section 34 of the Planning Act, RSO 1990.

Purpose and Effect: The Planning Act requires municipalities to update their Zoning By-laws following the update of an Official Plan. Zoning by-laws regulate the use of land, buildings and structures and apply to all properties in a municipality. As a result of a recent update to the East Nipissing Official Plan, the Municipality of Calvin has completed a review of its Zoning By-laws. Changes to the By-law include the addition of new definitions, modifications to a number of existing definitions and general provisions (accessory buildings, bed & breakfast establishments, helipad/heliport, home based businesses, recreational vehicles, wind turbines). The by-law also reduces the minimum lot frontage from 45 m to 30 m for uses in the Rural Zone and adds a separation distance between main buildings and accessory buildings. Certain lands accessible only by a private road have been reclassified as Limited Service Rural (LSR). The By-law applies to all lands within the Municipality.

Appeal - The last date for filing a notice of appeal of the by-law is April 3, 2010. Any such appeal must be filed with the clerk of the municipality and must set out the reasons for the appeal and must be accompanied by the fee required by the Ontario Municipal Board. Only individuals, corporations and public bodies may appeal a zoning by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.  No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person of public body made oral submissions at the public meeting or written submissions to the Council of the Municipality of Calvin or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

The amendment to the Zoning By-Law is available for inspection in the office of the clerk during regular office hours.

DATED at the Municipality of Calvin, March 10, 2010.
